A Study on the Legal and Ethical Issues of uterine transplantation

Abstract
In 2014, a woman with Mayer Roskitan Kuster-Hauser(MRKH syndrom) in her 30s who was born without a womb in Sweden gave birth to a baby after giving a uterus transplant from her mother. In the case of Japan, the uterus transplant clinical research plan was reviewed by the Japanese Medical Association in 2021 and approved. Some symposiums related to uterus transplantation in 2020 and 2021 are also being held in Korea, and the possibility of uterus transplantation is being discussed.
The uterus is similar to hands, arms, and legs in that it is not directly related to life(non-vital), but performs a special purpose of pregnancy and childbirth. Therefore, it is difficult to see the success of the transplantation only as a stable ¡¯engraftment¡¯ of the uterus, and the delivery of a healthy child through the transplanted uterus must be ensured. However, it is still difficult to guarantee whether the health of a child born through a uterine transplant can be guaranteed.
Although uterine transplantation has been researched by a small number of medical professionals and limited facilities so far, ethical standards must be considered for proper research to proceed. The ethical criteria to be considered in uterine transplantation are different from those required in general clinical studies because transplantation studies and procedures for pregnancy and childbirth are performed together. Therefore, in this study, the current status and characteristics of uterine transplantation will be examined, and legal and ethical issues related to uterine transplantation as clinical research and medical procedures will be reviewed.
